FlyBayArea will hold and transmit your personal information in a safe, confidential and secure environment.

II. Information Security

FlyBayArea is committed to handling your information with high standards of security. We have implemented several levels of fire-walling on our network. Information you enter on FlyBayArea is transferred to our servers using 128-bit Secure Socket Layer (SSL) encryption. Sensitive information such as credit card information, bank account information, social security number, medical certificate number, drivers license information, as well as other sensitive information is stored only in encrypted format.

Do not share your FlyBayArea password with anyone. If you share your password you will be liable for activity with your information. If there is any doubt that you are the only one with your password you should login to FlyBayArea and change your password. You should never email any sensitive information such as your password, credit card, or bank account information. FlyBayArea will never ask you to send your password to us via email. When you enter login information, the address bar at the top of your browser should read https://www.flybayarea.com/. Always check for this before you enter sensitive information. We also recommend that you keep your operating system and browser version up-to-date with the latest security patches which will help ensure the protection of your information.

Any e-mail or other communication requesting your password, asking you to provide sensitive account information via email, or linking to a web site with a URL that does not begin with https://www.flybayarea.com/ should be treated as suspicious and should be reported to FlyBayArea immediately by contacting us.

III. About The Information We Collect

Required Account Information

To have a user account on FlyBayArea, we require that you enter your name, address, phone number, email address, as well as a security question such as “what is the street you grew up on?” We will use this information for fraud prevention to verify your identity in case you forget or lose your password as well as for other verification purposes. If we cannot verify your identity using this information, we may have you fax information to us such as your driver’s license, utility bill, credit card statement, or bank statement, or may ask you other questions to verify you.

Newsletter, contests and sweepstakes information

Occasionally, FlyBayArea may offer users an opportunity to participate in a contest or sweepstakes. Information collected by FlyBayArea when you participate in a contest or sweepstakes may include your full name, e-mail address, and street address. You will not be automatically entered into contests and sweepstakes, but will have the option to participate if you would like.

Sensitive Information

For identification verification and for you and your flying organization’s convenience, we also allow you to provide us with additional information such as date of birth, social security number, passport number, nationality, gender, drivers license number, drivers license state, photo id, emergency contact information.

Pilot and Student Pilot Information

For identification purposes as well as to help remind you of expiration and pilot currency dates, you can also provide us with pilot currency information such as flight review date, medical expiration date, medical certificate number, medical certificate type, ratings and certificate information, as well as information on your insurance provider and coverage expiration.

Use of “Cookies”

We will use your e-mail address or telephone number to respond when you submit a question or suggestion, or request assistance with logging on to FlyBayArea, or accessing your account.

Questionnaires

We may offer optional questionnaires to our users to collect information on user interests and needs. If personally identifiable information is collected as a part of the questionnaire, FlyBayArea will make it clear in the questionnaire how the information will be used that is collected prior to user participation.

Information from other sources

Authorized company personnel may update your profile to accurately reflect any new profile information included in communications received from you.

We take your privacy very seriously and will not rent or sell any personally identifiable information to third parties. The following further describes how we use and disclose the information we collect.

Required Account Information

We collect your information and store it on our servers located in the United States. We use this information to do the following:

  • Provide you with customer service and support

  • We give you the option (in your Account Profile) to receive the FlyBayArea newsletter to stay informed on new features and service offerings.

  • Internal Purposes

We are in regular communication with our users answering requests for services and solving customer support issues. FlyBayArea sends out system emails on a regular basis such as to confirm your email address, notify you of upcoming reservations, upcoming currency expirations, as well as to send you notices and other informational disclosures required by law (for example, amendments to this privacy statement). These emails are not optional but are generally informational and helpful to you.

With your option you can receive the FlyBayArea newsletter to stay up to date on changes in services and new features and tips, as well as questionnaires. You can change these options at any time in the My Account section.

Computer Information

We use the information we collect about your computer, IP address, browser, and referrer page to improve your experience on FlyBayArea and to collect statistical information.

Flying Organization Use of Information

By entering into our Terms of Use agreement, with respect to other users personally identifiable information that you obtain through the site or FlyBayArea related communication, the Flying Organization will not share information other than for internal purposes of conducting day to day operations and for approved communication in regards to its own privacy statement or by the expressed consent of its users. In all cases users must be provided with a way to remove themselves from your database and review information you have collected about them. Under no circumstances, except as defined in this section, can you disclose personally identifiable information about users to any third party without our consent. We do not tolerate spam therefore you may not add a user to any spam mail list. To report spam, contact us.

Disclosure To Third-Parties

We want to make your interaction with your Flying Organization a more enjoyable experience by giving you a secure and reliable place in which to store your pilot information and other personally identifiable information. The Flying Organization you register with has access to the information you store in FlyBayArea. However for your security, your Flying Organization does not have access to your password. Other cases where your personally identifiable information is disclosed to third parties:

We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action.

If we deem it necessary, we may disclose information to cooperate in investigation of fraud or other illegal activity.

We share aggregated statistical data with potential business partners or to stimulate our marketing efforts. For example, we may disclose that “we have 10,000 registered users in Florida.” This information will not contain personally identifiable information.

We disclose certain personally identifiable information to our third-party training content Licensors as required.

V. Viewing And Updating Your Information

You can always review information provided by visiting the My Account section and make changes to that information by logging into your account.

VI. California Privacy Rights.

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of Personal Information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. In particular, the law requires that companies inform consumers about the categories of Personal Information that have been shared with third parties, the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties.
